Terms of Service

1. Agreement
By creating an account or using Marlo (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
The Service is operated by NPH Investment Corporation, a Delaware corporation ("Marlo," "we," "us," "our").
You must be at least 17 years old to use Marlo.
2. What Marlo does
Marlo is a voice journal. It:
- Records audio through your device microphone
- Uses third-party AI providers to transcribe that audio and refine it into text
- Stores your recordings, transcripts, and entries in your account
- Generates AI-assisted recaps, reflections, and insights from your entries
- Offers an AI "companion" that responds to what you have written
- Lets you send entries to people you choose, by email, SMS, or share link
3. Marlo is not therapy, medical care, or professional advice
This matters more than anything else in this document.
Marlo's companion and insight features are conversational software for personal reflection. They are not medical care, mental health treatment, therapy, crisis intervention, legal advice, or financial advice, and they are not a substitute for a qualified professional.
- Do not rely on Marlo for diagnosis, treatment, or any decision where being wrong would harm you.
- AI-generated content can be inaccurate, incomplete, or inappropriate to your situation. We make no warranty that it is any of those things.
- If you are in crisis or thinking about harming yourself, stop and contact a professional or emergency services. In the US, call or text 988 (Suicide & Crisis Lifeline) or call 911. In the UK, call 116 123 (Samaritans) or 999. Elsewhere, contact your local emergency number.
4. Your account
You agree to provide accurate information, keep your credentials secure, and take responsibility for activity under your account. Tell us promptly at support@marlojournal.com if you believe your account has been accessed without your permission.
We may suspend or terminate accounts that violate these Terms or our Acceptable Use Policy.
5. Your content is yours
You own everything you record and write in Marlo. We claim no ownership of your recordings, transcripts, or entries.
You grant us only the limited license we need to actually run the Service: to store, process, transmit, and display your content back to you, and to send it to the subprocessors listed in our Privacy Policy so they can transcribe or analyze it at your request. This license exists solely to operate the Service for you and ends when you delete the content or your account.
We do not use your content to train AI models, and we do not sell it.
6. Subscriptions and billing
6.1 Launch period
Marlo is currently in a free launch period. All features are available at no cost, no payment method is required, and no charge can occur. When the launch period ends, we will notify you before any paid plan begins, and you will never be charged without affirmatively subscribing.
6.2 Plans
Beyond the launch period, Marlo offers a Free tier and paid tiers. Pricing, features, and usage limits are described on our pricing page and may change with reasonable notice.
6.3 Web subscriptions (Stripe)
Web subscriptions are processed by Stripe. By subscribing you authorize recurring charges to your payment method until you cancel. Full auto-renewal and cancellation terms are in our Subscription Terms.
6.4 iOS subscriptions (Apple)
Any subscription purchased inside the iOS app is billed through your Apple ID and governed by Apple's Media Services Terms and standard end-user license agreement in addition to these Terms. Manage or cancel through your Apple ID subscription settings — we cannot cancel an Apple subscription on your behalf.
6.5 Refunds
Except where required by law, payments are non-refundable, and canceling stops future renewals rather than refunding the current period. We nevertheless consider good-faith refund requests at support@marlojournal.com. Purchases made through Apple are refunded by Apple, not by us.
6.6 Price changes
We will give at least 30 days' notice before a price change affecting your existing subscription, and you may cancel before it takes effect.
7. Acceptable use
You agree not to use Marlo to break the law, harass or harm others, infringe intellectual property, attempt to breach or overload our systems, or resell the Service. The full list is in our Acceptable Use Policy, which forms part of these Terms.
8. Recording others
You are responsible for how you use the microphone. Recording another person may require their consent under the laws of your state or country. Get consent before recording anyone but yourself.
9. Sharing
Share links let anyone holding the link view or listen to what you shared, with no account required. Treat a share link as public, and revoke it in the app when you are done.
10. Availability
We aim to keep Marlo running continuously but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features. If we discontinue the Service entirely, we will give reasonable notice and an opportunity to export your data.
11. Termination
You may stop using Marlo and delete your account at any time from Profile → Delete account. We may suspend or terminate your access for a material breach of these Terms, and where practical we will tell you why and give you a chance to export your data first.
12. Disclaimer of warranties
Except where the law does not allow it, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
13. Limitation of liability
To the maximum extent permitted by law, NPH Investment Corporation is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, or data. Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) US $100.
Some jurisdictions do not allow these exclusions, in which case they apply to you only to the extent permitted.
14. Indemnification
You agree to indemnify and hold harmless NPH Investment Corporation from claims arising out of your content, your use of the Service, or your violation of these Terms or of any law or third-party right.
15. Changes to these Terms
We may update these Terms. For material changes we will provide notice by email or in-app before they take effect. Continuing to use the Service after that means you accept the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, and you and we consent to their jurisdiction — except that either party may bring an individual claim in small claims court, and nothing here prevents you from exercising rights that cannot be waived under the law of your home country.
17. Miscellaneous
If any provision is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, Subscription Terms, Acceptable Use Policy, and AI Disclosure, are the entire agreement between you and us regarding the Service.
