Echo – Terms of Service

1. Agreement to Terms
By creating an account, downloading, or using Echo (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

You must be at least 17 years old to use Echo.
2. Description of Service
Echo is a software application that:
- Records audio captured through your device microphone
- Uses third-party AI providers to transcribe and refine that audio into text
- Stores your recordings, transcripts, and related metadata in a secure cloud account
- Generates AI-assisted summaries, recaps, and reflective content based on your entries
- Allows you to send refined messages via email, SMS, and other share targets
- Offers AI "companion" personas that may provide reflective, motivational, or perspective-based responses
3. Not Medical, Mental Health, Legal, or Financial Advice
Echo's AI companion features are not medical care, therapy, mental health treatment, legal advice, or financial advice. They are conversational tools intended for personal reflection and journaling support only.
- Do not rely on Echo for medical diagnosis, treatment, crisis support, legal counsel, or financial decisions.
- If you are in crisis or need urgent help, contact a qualified professional or your local emergency services (e.g., 911 in the US, 988 Suicide & Crisis Lifeline in the US, 116 123 Samaritans in the UK).
- We make no warranty that AI-generated content is accurate, complete, safe, or appropriate for your situation.
4. Account Registration
You agree to:
- Provide accurate, current information
- Keep your password and account credentials secure
- Be responsible for all activity under your account
- Notify us immediately of any unauthorized use
We may suspend or terminate accounts that violate these Terms.
5. Subscriptions and Billing
5.1 Tiers
Echo offers a Free tier and paid subscription tiers (currently "Personal" and "Pro"). Pricing, features, and quotas are described in the app and on our website and may change with notice.
5.2 Web Subscriptions (Stripe)
Web-based subscriptions are processed by Stripe. By subscribing, you authorize recurring charges to your payment method until you cancel. Cancel at any time via the in-app billing portal.
5.3 iOS Subscriptions (Apple In-App Purchase)
Subscriptions purchased through the iOS app are billed through your Apple ID and governed by Apple's standard EULA and Apple Media Services Terms, in addition to these Terms. Manage or cancel via your Apple ID Subscriptions settings.
5.4 Auto-Renewal
Subscriptions auto-renew at the end of each billing period unless canceled at least 24 hours before renewal. Renewal charges occur within 24 hours of period end.
5.5 Refunds
Web subscriptions: refunds are at our discretion except where required by law. iOS subscriptions: refund requests must be made through Apple.
5.6 Free Trials
We may offer a free trial. If you do not cancel before the trial ends, you will be automatically charged for the next subscription period.
5.7 Usage Limits
Each tier includes a monthly recording-minute quota and feature set. Exceeding the quota may result in limited functionality until the next billing cycle or until you upgrade.
6. Your Content
6.1 Ownership
You retain ownership of all audio recordings, transcripts, journal entries, and other content you create in Echo ("Your Content").
6.2 License to Us
You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, transmit, transcribe, process, and display Your Content solely to provide the Service to you. This license terminates when you delete the content or your account, except for backups retained for a limited operational period.
6.3 We Do Not Train AI Models on Your Content
We do not use Your Content to train our own AI models. Third-party AI providers we use (currently OpenAI for transcription and Anthropic for AI processing) are bound by data-processing agreements that prohibit training on customer content as of the Effective Date. 6.4 Sharing
When you choose to send a message via email, SMS, or share targets, you are responsible for the content you send and for complying with applicable laws (anti-spam, privacy, consent to record, etc.).
6.5 Recording Consent
You are solely responsible for obtaining any required consents when recording other people's voices or sharing their information. Recording laws vary by jurisdiction (one-party vs. all-party consent states). Do not use Echo to record others unlawfully.
7. Acceptable Use
You agree not to:
- Violate any law or third-party right
- Upload or generate content that is unlawful, harassing, defamatory, threatening, hateful, sexually explicit involving minors, or that infringes intellectual property
- Reverse-engineer, decompile, or attempt to extract source code
- Use the Service to send spam, phishing, or unsolicited bulk messages
- Use automated means (bots, scrapers) to access the Service except as expressly permitted
- Resell, sublicense, or commercially exploit the Service without our written permission
- Attempt to circumvent usage quotas or security measures
- Impersonate another person or misrepresent your identity
We may remove content and terminate accounts that violate this section.
8. AI-Generated Content Disclaimer
The Service uses generative AI. AI output may be inaccurate, biased, offensive, or otherwise unsuitable. You are responsible for reviewing AI-generated content before sending or relying on it. We are not liable for decisions you make based on AI output.
9. Privacy
Our Privacy Policy explains how we collect, use, and protect personal data. By using the Service you agree to our privacy practices.
10. Intellectual Property
The Service, including its software, design, branding, and content (excluding Your Content), is owned by us and our licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial use, subject to these Terms.
11. Third-Party Services
Echo integrates with third-party services including but not limited to: Apple (Sign in with Apple, App Store, IAP), Google (Sign in with Google), Stripe (payments), Supabase (data hosting), OpenAI (transcription), Anthropic (AI processing), Resend (email), and RevenueCat (subscription management). Your use of those services is governed by their own terms.
12. Termination
You may delete your account at any time from in-app settings. Upon deletion, Your Content will be removed within a reasonable operational period (typically 30 days), except as required by law.
We may suspend or terminate your access if you violate these Terms or for legal, security, or operational reasons. We will provide notice where reasonably possible.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED SERVICE.
WE DO NOT WARRANT THAT AI-GENERATED OUTPUT IS ACCURATE OR APPROPRIATE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, [YOUR LLC NAME] AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (b) USD $100.
Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the maximum extent permitted by law.
15. Indemnification
You agree to indemnify and hold harmless [YOUR LLC NAME] from claims arising out of (a) Your Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any third-party right.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of [YOUR STATE], USA, without regard to conflict-of-laws rules.
Any dispute will be resolved by binding individual arbitration administered by [JAMS / AAA] in [YOUR COUNTY, STATE], except that either party may bring an individual claim in small-claims court. YOU WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION.

If you accessed Echo through the Apple App Store, you acknowledge that:

- Apple is a third-party beneficiary of these Terms and may enforce them against you
